Capital gains tax withholding as of 2022

Dear customers,

since 01.01.2021 the new income tax law and the new system of the final withholding tax applies, we have already informed you about it here.

Within the scope of the capital gains tax deduction, there will be no automatic deduction of the final withholding tax according to the new regulations until 31.12.2021, as FXFlat makes use of an exemption regulation (permitted according to the letter of the Federal Ministry of Finance from 11.11.2020).

We would like to point out that from 01.01.2022 (end of the exemption regulation) we will implement the amended regulations mandatorily at customer level, i.e. for each trade that is concluded with a profit, the withholding tax will be deducted. Losses will no longer be automatically offset against profits.

Therefore, you as a customer still have the mandatory obligation to report all your profits and losses to the tax office yourself within the framework of a tax return and to pay tax in accordance with the regulation applicable from 01.01.2021!
